Terms of Service and Privacy Policy

1. Introduction and Legal Framework
These Unified Terms of Service and Privacy Policy (the "Agreement") constitute a legally binding contract between you ("User," "you," or "your") and iBetter ("Company," "we," "us," or "our").
By downloading, installing, accessing, or using iBetter, you acknowledge that you have read, understood, and agree to be bound by this Agreement. If you do not agree, you must not use the Service.
2. Eligibility
The Service is intended for individuals who are at least thirteen (13) years old.
If you are between thirteen (13) and seventeen (17) years old, you may use the Service only with the involvement, supervision, and consent of a parent or legal guardian, where permitted by applicable law.
The Service is not directed to children under the age of thirteen (13), and we do not knowingly collect personal data from children under thirteen. If we become aware that such data has been collected, it will be deleted promptly.
Where local laws require a higher minimum age for consent to data processing, such higher age shall apply.
You represent and warrant that all information you provide is accurate and truthful.
3. Nature of the Service
iBetter is a proprietary digital fitness platform designed to provide workout planning tools, exercise libraries with video demonstrations, performance tracking, and habit-building features.
The Service is informational and educational in nature. It is not intended to diagnose, treat, cure, or prevent any medical condition. iBetter does not provide medical advice, physical therapy, rehabilitation services, or clinical supervision.
No physician-patient, therapist-patient, or trainer-client relationship is created by your use of the Service.
You acknowledge that fitness outcomes depend on numerous factors outside the control of iBetter, including but not limited to nutrition, genetics, physical condition, and consistency of effort. Accordingly, iBetter makes no guarantee regarding strength gains, fat loss, muscle hypertrophy, endurance improvement, or achievement of any specific fitness objective.
4. Medical Disclaimer and Assumption of Risk
You understand and expressly acknowledge that physical exercise involves inherent risks, including but not limited to serious bodily injury, permanent disability, or death.
You are solely responsible for determining whether participation in any exercise program is appropriate for you.
You should consult a licensed physician or qualified healthcare professional prior to beginning any workout program, especially if you have pre-existing medical conditions, cardiovascular issues, injuries, chronic diseases, or are pregnant.
If you experience dizziness, faintness, shortness of breath, chest pain, severe fatigue, musculoskeletal pain, or any physical discomfort while exercising, you must stop immediately.
By using the Service, you voluntarily assume all risks associated with physical activity and release iBetter from liability to the fullest extent permitted by law.
5. User Accounts and Content
Users may use iBetter without creating an account. Optional account features may be available via Apple Sign-In, Google Sign-In, or other authentication methods.
You are responsible for safeguarding your credentials and for all activity under your account.
Users may upload profile images, workout photos, and related content. By uploading such content, you grant iBetter a non-exclusive, worldwide license to store and process such content for operational purposes.
You represent that you own or have appropriate rights to any content you upload and that such content does not violate applicable law.
iBetter reserves the right to suspend or terminate accounts for misuse, fraud, or violation of this Agreement.
6. Subscriptions and Premium Access
iBetter offers a premium subscription service ("Premium") that provides access to enhanced features, including unlimited exercise library access, unlimited workout creation, full progress and statistics, personal records tracking, and advanced analytics.
Access to Premium features requires an active paid subscription.
Purchase and Billing All subscriptions are purchased exclusively through the Apple App Store or Google Play Store. iBetter does not directly process payment card information. Pricing may vary depending on your country of residence, currency, and applicable taxes.
Automatic Renewal Subscriptions automatically renew at the end of each billing cycle unless canceled at least twenty-four (24) hours prior to the expiration of the current subscription period. Deleting or uninstalling the application does not cancel your subscription.
Cancellation You may cancel your subscription at any time through your Apple ID account settings (for iOS users) or Google Play account settings (for Android users). Cancellation will take effect at the end of the current billing period. No partial refunds are provided for unused portions of a billing cycle unless required by applicable law.
Refunds All refund requests must be submitted directly to Apple or Google, as applicable. iBetter does not have access to platform billing systems and cannot independently issue refunds for in-app purchases.
7. Intellectual Property
All intellectual property rights in the Service, including but not limited to software code, algorithms, exercise libraries, workout structures, video demonstrations, graphics, branding, and design elements, are owned exclusively by the Company.
You are granted a limited, non-exclusive, non-transferable license to use the Service for personal, non-commercial purposes.
You may not reverse engineer, decompile, scrape, copy, reproduce, or commercially exploit any portion of the Service.
8. Data Collection and Privacy
iBetter collects and processes personal data strictly to the extent necessary to provide, maintain, improve, and secure the Service.
The categories of personal data processed may include:
• Workout and Performance Data — Workout history, training volume, repetitions, exercise completion data, performance metrics, and user-generated workout logs.
• Device and Usage Information — Device identifiers, operating system information, in-app event data, interaction logs, performance metrics, and crash diagnostics.
• Subscription and Purchase Information — Subscription status, purchase history, and receipt validation data.
• Post-Workout Content — Photos, mood entries, and personal notes voluntarily submitted after workouts.
We do not sell personal data. We do not share personal data with third parties for their own independent commercial purposes.
9. Third-Party Service Providers
To operate the Service efficiently and securely, iBetter may engage carefully selected third-party service providers. These providers act as data processors under our instructions and are contractually bound to process personal data solely for specified operational purposes.
These may include infrastructure and cloud services, subscription management and billing validation, analytics and performance monitoring, and crash reporting services.
All third-party service providers are subject to contractual data processing agreements where required under applicable privacy laws.
10. International Transfers
Data may be processed in jurisdictions where our infrastructure or service providers operate.
For EU/UK users, international transfers rely on Standard Contractual Clauses or equivalent safeguards.
11. Data Subject Rights
Subject to applicable law (including GDPR, CPRA/CCPA, LGPD), you may request:

12. Data Retention and Deletion
Personal data is retained only as long as necessary to provide the Service or comply with legal obligations.
Upon account deletion, user data is deleted from operational databases, subject to backup retention policies and legal requirements.
13. Data Security
We implement commercially reasonable technical, administrative, and organizational safeguards designed to protect personal data against unauthorized access, disclosure, alteration, or destruction.
However, no method of transmission over the internet or method of electronic storage is entirely secure. Accordingly, while we strive to protect personal data, we cannot guarantee absolute security.
To the maximum extent permitted by applicable law, iBetter shall not be liable for unauthorized access, security breaches, or third-party actions resulting from circumstances beyond our reasonable control.
14. Limitation of Liability
To the maximum extent permitted by law, iBetter's total liability for any claim arising out of or relating to this Agreement shall not exceed the amount paid by you to iBetter during the twelve (12) months preceding the claim.
iBetter shall not be liable for indirect, incidental, consequential, punitive, or special damages, including loss of profits or health-related complications.
The Service is provided "AS IS" and "AS AVAILABLE."
15. Indemnification
You agree to indemnify, defend, and hold harmless the Company from any claims, liabilities, damages, or expenses arising out of your misuse of the Service, violation of this Agreement, or violation of applicable law.
16. Modifications
We may update this Agreement from time to time to reflect legal, regulatory, operational, or business changes. The updated version will be made available within the application and on our website and will include a revised "Effective Date."
Your continued use of the Service after the Effective Date of any update constitutes your acceptance of the revised terms. If you do not agree with the updated Agreement, you must discontinue use of the Service and cancel any active subscriptions.
